DMCA Policy
Copyright notice-and-takedown procedures under 17 USC §512.
Locals of Texas respects the intellectual property rights of others and expects its users to do the same. We respond to clear notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act ("DMCA"), 17 USC §512.
Designated DMCA agent
Send DMCA takedown notices and counter-notices to our designated agent:
Our agent is also registered with the U.S. Copyright Office at dmca.copyright.gov/osp.
Submitting a takedown notice (§512(c)(3))
To be effective, a notice must include substantially all of the following:
- Identification of the copyrighted work you claim has been infringed.
- Identification of the material you claim is infringing, with a URL or other information reasonably sufficient for us to locate it.
- Your contact information: name, address, telephone number, and email.
- A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
- Your physical or electronic signature.
Warning: 17 USC §512(f) allows damages — including costs and attorneys' fees — against anyone who knowingly misrepresents that material is infringing. Do not submit a notice unless you are sure the material is infringing and you are the rights holder or their authorized agent.
Submitting a counter-notice (§512(g))
If we removed content you posted and you believe the removal was a mistake or misidentification, you may submit a counter-notice containing:
- Identification of the material that was removed and the location where it appeared before removal.
- A statement, under penalty of perjury, that you have a good-faith belief that the material was removed as a result of mistake or misidentification.
- Your name, address, telephone number, and email.
- A statement that you consent to the jurisdiction of the federal district court for the district in which your address is located (or, if outside the U.S., the Western District of Texas), and that you will accept service of process from the person who filed the original notice or their agent.
- Your physical or electronic signature.
If we receive a valid counter-notice, we will forward it to the original complainant and may restore the removed material in 10–14 business days unless we receive notice that the complainant has filed a court action seeking a restraining order.
Repeat-infringer policy
It is our policy, in appropriate circumstances and at our discretion, to disable, suspend, and/or terminate the accounts of users who repeatedly infringe or are repeatedly charged with infringing the copyrights of others.
